This Agreement is dated and agreed upon the date set out below. It is made between (1) TWS (company no: 16595888) and (2) the person(s) booking and/or (3) the person(s) undertaking the Activity (“You” and “Your”).
In this Agreement the Activity means woodworking, DIY, specialty classes and any training workshop. You may use hand and power tools and machinery and other equipment whilst participating in any Activity.
In consideration of the covenants and agreements contained in this Agreement and other good and valuable consideration, the receipt of which is hereby acknowledged, We (meaning both TWS and You) agree as follows:
Release
You release and forever discharge TWS (which for this purpose includes our officers, employees, those providing training or leading any Activity) and other course participants and anyone else making use of TWS’s premises or equipment (including all TWS’s and their assigns) from all loss, damage, actions, causes of action, debts, accounts, contracts, claims and demands for or by any reason of any injury to person or property, including indirect or consequential loss or damage. Nothing in this disclaimer shall be construed as limiting or excluding TWS’s liability for:
(a)personal injury which arises as a consequence of TWS’s negligence, or the negligence of TWS’s staff; or
(b)fraudulent misrepresentation; or
(c)any other matter for which it would be illegal or unlawful for TWS to exclude or attempt to exclude its liability.
You understand and agree that You are not permitted to participate in the Activity unless You agree to this Agreement.
You acknowledges that this Agreement is given with the express intention of effecting the extinguishment of certain obligations owed to You, and with the intention of binding You and Your spouse, heirs, executors, administrators, legal representatives and assigns.
Fitness to Participate
You acknowledge that You do not have any physical limitations, medical ailments, physical or mental disabilities that would limit or prevent You from participating in the Activity. If required You will obtain a medical examination and clearance and provide that to TWS.
Refunds
Any fee is payable before You attend TWS for, or participate in, the Activity.
TWS agrees that:
You may have to miss a class when unexpected things come up. You can attend an alternative class on another date or cancel that class entirely if You notify TWS at least seven days in advance of the Activity.
Where you have booked woodworking/DIY only, then you can cancel your Activity at least 24 hours before your booked session is due to start.
No refund will be made for bookings cancelled on less notice (than stated in 1 or 2 above as relevant) except in exceptional circumstances and then only at TWS’s absolute discretion.
No refund will be made for non-attendance by You of a booking.
While TWS seek to make every effort to run classes as advertised and to allow booked Activity, TWS reserve the right to change the timetable without prior notice and to cancel or to rearrange any courses and any Activity without liability. TWS will endeavour to inform all participants fourteen days before the class or Activity is due to take place, although please be aware that this is not always possible. If eligible for a refund, all class fees paid will be reimbursed in full, but TWS are unable to reimburse any other costs that may have been incurred, including travel and/or accommodation etc.
Full and Final Settlement
You acknowledge and agree that You have carefully read this Agreement and that You fully understand and agree the same and that You freely and voluntarily execute the same.
You understand that by agreeing to this Agreement You agree to be forever prevented from suing or otherwise claiming against TWS for any property loss or personal injury that You may sustain while participating in or preparing for the Activity.
You have been given the opportunity and have been encouraged to seek independent legal advice prior to agreeing to this Agreement.
This Agreement contains the entire agreement between the parties and the terms of this Agreement are contractual and not a mere recital.
Governing Law
This Agreement will be construed in accordance with and governed by the laws of England.
Agreement
You have read and fully understood all the terms of this disclaimer. If any court or competent authority finds that any provision of this document (or part of any provision) is invalid, illegal or unenforceable, that provision or part provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this agreement shall not be affected.
In booking for or attending an Activity You agree to and accept the above.
